1. Agreement and scope.

These Terms of Use apply to the BlinkTide macOS application and its optional annual subscription. By downloading, accessing or using the app, you agree to these terms. If you do not agree, do not use the app.

BlinkTide is a productivity reminder designed to support a calmer screen routine. It is not a medical device and does not provide medical advice, diagnosis or treatment.

2. Licence and intellectual property.

Subject to these terms and the applicable Apple Media Services Terms and Conditions, you receive a personal, limited, non-exclusive, non-transferable and revocable licence to use BlinkTide on Apple devices that you own or control. BlinkTide, its software, design, trademarks and all related intellectual-property rights remain owned by the publisher or its licensors.

You may not copy, modify, distribute, sell, rent, lease, sublicense, reverse engineer, decompile or attempt to extract the app’s source code, except where applicable law expressly permits that activity. You may not use the app unlawfully, interfere with its operation or remove proprietary notices.

3. Optional annual subscription.

BlinkTide may offer an auto-renewable annual subscription, including a seven-day introductory offer for eligible customers. The subscription name, duration, current total renewal price, currency, offer eligibility and services included are shown in Apple’s purchase sheet and on the App Store. Those Apple-displayed terms control the purchase.

Payment is charged to your Apple Account when you confirm the purchase. The subscription renews automatically unless you cancel it at least 24 hours before the end of the current period. Apple will charge your Apple Account for renewal within 24 hours before the end of the current period.

You can manage or cancel your subscription in your Apple Account subscription settings on your device. Deleting BlinkTide does not cancel a subscription. Trial eligibility, billing, renewals, refunds, cancellations, purchases and restores are managed by Apple under its applicable terms and policies. Any request concerning an Apple-billed refund must be made through Apple’s applicable support channels.

4. Access, availability and changes.

An active Apple entitlement is required for subscription-only features. We may modify, update, suspend or discontinue all or part of the app when reasonably necessary for security, legal compliance, maintenance, compatibility or product improvement. We will not make a material change to a paid subscription without the notice or remedy required by applicable law.

The app is provided through Apple’s services and depends on your compatible device, macOS, camera permission and Apple Account where a subscription is used. We do not guarantee uninterrupted, error-free or universally compatible availability.

5. Responsible use and health disclaimer.

You are responsible for using the app safely and in accordance with applicable law. Do not rely on blink estimates, reminders or any output from BlinkTide for medical decisions, diagnosis, treatment, emergency decisions or professional advice. Lighting, eyewear, camera position, device performance and other conditions can affect estimates. Consult a qualified health professional if you have health concerns.

6. Disclaimers and limitation of liability.

To the maximum extent permitted by applicable law, BlinkTide is provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, availability or error-free operation.

To the maximum extent permitted by applicable law, the publisher will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of data, profits, goodwill, business opportunity or use, arising from or related to the app or these terms. Where liability may legally be limited, the publisher’s aggregate liability is limited to the amount you paid for BlinkTide in the 12 months before the event giving rise to the claim.

Nothing in these terms excludes or limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any liability or consumer right that cannot legally be excluded or limited.

7. Privacy.

Camera frames and blink-related analysis are processed locally on your Mac. BlinkTide does not record, upload, sell or share those data. Our Privacy Policy explains the app’s data practices, support-email processing and how to contact us about privacy.

8. Termination.

These terms remain in effect while you use the app. We may suspend or terminate your licence if you materially breach these terms or where required for legal or security reasons. You may stop using the app at any time. Sections that by their nature should survive termination, including intellectual property, disclaimers, liability limits and mandatory-rights provisions, will survive.

9. Support and contact.

For support, questions or notices about these terms, contact info@kerny.it. We may communicate with you in response to a message you send us. Email support does not create a guaranteed support level, response time or service-level commitment.

10. Your legal rights.

Nothing in these terms limits or excludes rights that cannot be limited or excluded under applicable law. If you are a consumer, you retain all mandatory consumer protections available in your country or region of residence. If any part of these terms is unenforceable, the remaining provisions remain in effect to the extent permitted by law.

11. Changes to these terms.

We may update these terms when the app, subscription or law changes. The current version is published on this page. If an update is material, we will provide notice where required by law. Continued use after an updated version takes effect means you accept the revised terms, except where applicable law requires a different process.
